SCHEDULE OF REPAIRS AND RENOVATIONS:

Improvements to the Common Property and Shared Elements – This work is to be substantially completed prior to the earlier of September 30th, 2009.

Common Areas:

  • The repainting of all parking lines and parking space numbers in a sequential order
  • The repair or replacement of electrical bollards for parking plug-ins, as required
  • The repair of common area lighting and site signage as required
  • The repair of parking lot lighting, as required

Common Area Landscaping:

  • The professional pruning of existing trees, as required
  • The replacement of dead planting materials and the planting of additional trees and shrubs as required
  • The repair and re-grading, as required of all grassed areas, to ensure proper drainage
  • New fencing on all enclosed terrace and patio areas

Common Area Lighting and Signage:

  • The repair of common area lighting and site signage, as required

Building Exteriors – General

  • Each town home will benefit from a New contemporary exterior colour scheme with new exterior stucco and soffit and fascia as required at builder’s discretion. Colours selected by the Vendor’s colour consultant – completed by Summer of 2008
  • The installation of a new numerals, new mail box, and new exterior entry – completed in the Summer of 2008
  • The installation of front and rear terrace door lights if applicable– completed in the Summer of 2008
  • The repair and new installation of terrace areas with interlock, as required
  • Recently installed New windows, including screens, patio sliding doors operating hardware, glides and weather-stripping installed

Warranty:

  • The Vendor will provide a three month general warranty, plus any applicable manufacturer’s warranties on new materials and workmanship

Structural Inspections:

  • A detailed reserve fund study has been conducted by a registered engineer specializing in the inspection of all major interior components of a representative sample of all town homes within the development, randomly selected. All remedial repairs will be completed in accordance to the study.

Flooring:

  • The installation of new ceramic flooring in foyer, kitchen and bathroom as per Vendor’s samples
  • The re-sanding or re-screening of existing parquet flooring and stained with Purchaser’s choice of 3 colour stains from Vendor’s samples

   
Doors and Trim:

  • The installation of colonial interior doors and sliding or bifold closet colonial doors as per Vendor’s choice
  • The installation of interior door hardware
  • The installation of new colonial extra wide baseboards and colonial trim

Walls and Ceilings:

  • The repair of damaged plaster and drywall, as required
  • The repair and refinishing of damaged areas of stippled ceilings, as required

Cabinetry and Countertops:

  • The installation of new kitchen and main bathroom upgraded cabinetry from Vendor’s samples – Purchaser’s choice from selections
  • The installation of all new kitchen arborite countertops from builder’s samples
  • The installation of bathroom arborite countertops from Vendor’s samples – Purchaser’s choice from selections
  • The installation of new upgraded cabinet door handles in kitchen, and main bathroom from Vendor’s samples – Purchaser’s choice from selections

Design and Décor:

  • Installation of  new oak railings and oak spindles – stained to match floor coloring

Painting:

  • The complete painting of all interior walls, trim and doors, with 2 coats of Vendor’s choice of off white eggshell latex paint, 2 coats of flat white on all ceilings – one color choice only throughout the home

Lighting and Electrical:

  • The installation of a battery smoke detector if not already installed
  • New strip lighting in bathroom(s)
  • Installation of new white ceramic bathroom accessories and new mirror
  • The installation of a new white or black kitchen hood fan installed over stove area
  • New light fixtures to be installed in kitchen, hallways, and bathroom as per
  • Vendor’s selections
  • Installation of white decora electrical switches and outlets

Plumbing:

  • The replacement of all bathtubs and ceramic tub surround - purchaser’s choice of colour from Vendor’s samples
  • The replacement of new chrome bathroom taps and shower taps from Vendor’s samples
  • The installation of a new single stainless steel sink as per plan with new upgraded chrome taps
  • Installation of new white oval sink in Main Bathroom and cabinetry
  • The installation of new toilets (white) from Vendor’s samples
  • Rough-in for future dishwasher

Warranty:

  • The Vendor will provide a three month general warranty, plus any applicable manufacturer’s warranties on new materials and workmanship

Appliances:

  • For a limited time only Purchaser’s choice of black or white appliances in kitchen including hood fan, refrigerator, stove, dishwasher and microwave and stackable white washer and dryer (or side by side as per plan – builder’s discretion) from builders samples

 

Notes:

  • The Purchaser acknowledges and agrees that the renovations to the common property as well as to the various units shown on the site plan including the property have been ongoing since Fall of 2007.  The purchaser further acknowledges and agrees that some of the renovations and improvements set out in this schedule of renovations may already have been completed in which case the vendor shall have no further obligation with respect to such completed work not withstanding that the reference to such work is included on the schedule of renovations.
  • The Purchaser acknowledges and agrees that where in this Schedule of Repairs and Renovations the repair, refinishing or replacement of any building component or finishing is indicated to be on an as required basis, the decision to repair, refinish or replace any building component or finishing shall be made at the sole discretion of the Vendor.
  • This Schedule may contain changes from and supersedes all previous sales material and brochures which may have been delivered to the Purchaser and is subject to further changes as set out in the Agreement of Purchase and Sale
  • The Purchaser acknowledges and agrees that all selections of colours and materials with respect to renovations in this Schedule where it is indicated that the Purchaser will have such selection will be from Vendor’s samples and must be completed on the earlier of fourteen (14) days following the date of acceptance of this Agreement fourteen (14) days following the date on which the conditions in any Schedule to this Agreement have been satisfied or waived.  In the event the Purchaser fails to make such selections within the time aforesaid, the Purchaser acknowledges and agrees that the Vendor shall be entitled to make such selections on behalf of the Purchaser and that any such selections made by the Vendor shall be final and binding on the Purchaser.
  • The Purchaser acknowledges and agrees that if any choice of colour or material is not available or if the Vendor expects that the time for delivery will delay the completion of renovations to the Property, the Vendor shall be entitled to notify the Purchaser to that effect and the Purchaser shall have forty eight (48) hours following such notification to make an alternative selection, provided that any delay caused by the unavailability of the Purchaser’s selections shall, at the Vendor’s option, cause the Date of Closing to be extended by the extent of the delay and the date for adjustments shall remain as of the original Date of Closing.
  • The Purchaser acknowledges that the right to make selections as provided for in this Schedule is not a fundamental provision of the Agreement between the Purchaser and Vendor and that any omission or failure of the Vendor to supply a colour or material as selected by the Purchaser shall not in any manner impose any liability or obligation on the Vendor to the Purchaser and the Purchaser shall not be entitled under any circumstances to require such colour or material to be delivered or to claim damages against the Vendor for failure to do so. The vendor reserves the right to substitute a purchaser’s choice or finishing’s as described above with an item of equal or greater value
